Terms of Service

These Terms of Service ("Terms") govern your access to and use of Clockcake, the time-tracking, scheduling, leave and payroll service operated by us ("Clockcake", "we", "us"). By creating an account or using Clockcake, you agree to these Terms. If you use Clockcake on behalf of an organization, you confirm that you are authorized to bind that organization.
Acceptance of these terms
By accessing or using Clockcake, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service. We may require you to accept updated Terms in order to keep using Clockcake.
The service
Clockcake helps organizations track work time, schedule shifts, manage leave and prepare payroll. Features may vary by plan and may change over time. Clockcake is intended for business use by employers and their workers, not for personal consumer use.
Your account
You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 16 years old and legally able to enter into these Terms. Notify us promptly of any unauthorized use of your account.
Acceptable use
You agree not to misuse the service: no illegal activity, no infringing or harmful content, no attempts to disrupt, reverse engineer, scrape or gain unauthorized access, and no use that violates the rights of others or applicable law.
Your data and legal responsibilities
You retain ownership of the data you submit. When you track employees, you act as the data controller and are responsible for having a lawful basis, informing your workers and complying with applicable labor, privacy and monitoring laws. How we handle personal data is described in our Privacy Policy.
Plans, billing and trial
Paid plans are billed annually in advance through our payment provider, Paddle, which acts as Merchant of Record and collects applicable taxes. New workspaces include a 90-day free trial. Subscriptions renew automatically unless cancelled, and prices may change with notice for future billing periods.
Cancellation and refunds
You can cancel anytime from the billing page; cancellation takes effect at the end of the current billing period and there is no early-termination fee. We offer a 14-day refund window on first-time subscriptions. After the period ends, the workspace is locked but your data is not immediately deleted.
Intellectual property
Clockcake and its software, design and trademarks belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not copy, modify or create derivative works except as permitted by law.
Disclaimers and limitation of liability
The service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability is limited to the fees you paid for the service in the 12 months before the claim.
Suspension and termination
We may suspend or terminate access if you breach these Terms, fail to pay, or where needed to protect the service or other users. You may stop using Clockcake at any time. On termination we may delete your data after a reasonable export period, subject to legal retention requirements.
Governing law
These Terms are governed by the laws of Taiwan (Republic of China), without regard to its conflict-of-law rules, and the competent courts located there will have jurisdiction, unless mandatory law in your country of residence provides otherwise.
Changes to these terms
We may update these Terms from time to time. We will revise the "last updated" date above and, for material changes, notify you in the app or by email. Continued use after the changes take effect means you accept the updated Terms.

These Terms of Service are provided in several languages for your convenience. If there is any conflict between translations, the English version prevails.
